By purchasing the software, you are thereby indicating your knowledge of and full agreement with all terms and conditions set forth in this agreement. MisspelledDomains.com reserves the right to, at any time, choose to add, delete and/or edit portions of this agreement in order to accomplish necessary changes or improvements to the agreement without preceding same by notification. You are free to check back at any time for any upgraded policies, however, and are encouraged to do so.

Responsibility of Customers:

You are solely responsible for any and all uses of your MisspelledDomains.com software programs and the data derived from and obtained therein. Should any instances of fraud, system abuse, copyright infringement or any type of activity deemed to be inappropriate or illegal, by you, or anyone you authorize to use your copy of the software, that may result in possible legal action, occur at any time after your initial purchase, you indemnify & release misspelleddomains software and its owners from any liability for your own actions.  You are solely & totally responsible for your use & actions regarding the MisspelledDomains Software and agree to same by choosing to purchase it.

Relationship of the Parties: 

You and MisspelledDomains.com are independent entities, and nothing in this Terms of Use creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and MisspelledDomains.com or its owners. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section.

A portion of our software program is dependent on other Internet Services and Service Providers. There may be temporary outages at our Service providers servers. These usually last for a short while but sometimes can take longer. Should there be a lack of cooperation or failure in their services coexisting with ours in the future and our Software becomes nonfunctional or unoperable, we cannot and will not be held responsible. We will not be able to grant a refund if this should occur. Should this unlikely event occur, we will make every attempt to fix the problem, though we are not bound by contract or agreement to do so.  (We proved this in March 2003, when InterNIC changed their policies and rendered our software less functional, and we paid the developer to fix it.  It is now better than ever.  We sincerely do try to keep our software top-notch for your satisfaction if at all possible.)  All of our customers will receive free upgrades for life.

The accuracy of results displayed or the accuracy of the software in whole is again dependent on third parties not owned by MisspelledDomains.com. Should there be conflicting views on the accuracy, we shall not be held responsible in any way. Our program gives the best approximation possible based on the information available to us provided by these third party firms.

We do not recommend and strongly advise against the registration of Domain Names that violate Registered Trademarks and Copyrights.  Check with I.C.A.N.N. and W.I.P.O. for copyright & intellectual property laws before registering any domain name if you have any doubts about your website naming choices.  This is for your protection!  Seek competent legal counsel if you have any doubts whatsoever.

Limitation of Liability: 

MisspelledDomains.com will not be held liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Terms of Use Agreement or the MisspelledDomains.com website, or of the use of our software, even if MisspelledDomains.com has been advised of the possibility of such damages. As with any software purchase, there are no guarantees of any amount of income generated from use of the software. Just as with any business endeavor, your success will be based on your own abilities and blame cannot be reassigned. You can easily make a lot of money from the knowledge & valuable data gleaned from use of the program or you may not make any. All data examples on the website are included for illustrational reference only, as previously outlined. 

Terms of Choice:

In any instance of claim or dispute, it will be settled in English, and in a court within 100 miles of Columbia County, FL, USA, and if you do not agree with any of the terms of use, you have the right not to participate in our software offer.
